General Terms and Conditions of Sale for Services Offered by Skillsmetry

Effective as of 01/01/2025

ARTICLE 1 – Scope of Application

These General Terms and Conditions of Sale (hereinafter referred to as “GTC”) apply, without restriction or reservation, to any purchase of the following services:

• Individual coaching
• Skills improvement and mock interviews
• ETHS Test
• Preparation for the ETHS Test
• Portuguese language courses

As offered by the Service Provider to non-professional clients on the website www.skillsmetry.com.

The main characteristics of the Services are presented on the website www.skillsmetry.com. The Client is required to review them before placing any order. The choice and purchase of a Service are the sole responsibility of the Client.

These GTC are accessible at any time on the website www.skillsmetry.com and shall prevail over any other document.

The Client acknowledges having read these GTC and accepted them by ticking the checkbox provided for this purpose before completing the online ordering process.

Unless proven otherwise, the data recorded in the Service Provider’s computer system shall constitute proof of all transactions concluded with the Client.

ARTICLE 2 – Prices

The Services are provided at the prices in force displayed on www.skillsmetry.com at the time the order is registered.

Prices are expressed in euros, all taxes included (VAT included).

Prices take into account any discounts granted by the Service Provider. They are firm and non-revisable during their period of validity.

An invoice is issued by the Service Provider and provided to the Client upon delivery of the ordered Services.

ARTICLE 3 – Orders

The Client selects the Services they wish to order on www.skillsmetry.com, chooses a time slot in the calendar, and proceeds with payment.

The sale shall be deemed final only after full payment of the price. The Client is responsible for verifying the accuracy of the order.

Any order placed on the website constitutes a distance contract between the Client and the Service Provider.

The Service Provider reserves the right to cancel or refuse any order in the event of a dispute relating to a previous order.

ARTICLE 4 – Payment Terms

Payment is made via secure payment methods as follows:

• Payment by credit card

The price is payable in full at the time the order is placed.

Payment data is exchanged in encrypted mode via the approved payment service provider.

ARTICLE 5 – Provision of Services

The Services are provided within a maximum period of one hour following final validation of the order.

In the event of non-provision within 12 hours (excluding force majeure), the Client may request termination of the contract and a full refund.

Any complaint must be sent by email to contact@skillsmetry.com within 24 hours following the provision of the Service.

ARTICLE 6 – Right of Withdrawal

In accordance with the law, the right of withdrawal does not apply to digital content whose execution has begun after the Client’s express prior consent.

ARTICLE 7 – Liability and Guarantees

The Service Provider guarantees the conformity of the Services in accordance with applicable legal provisions.

The Service Provider’s liability is limited to reimbursement of the Services actually paid for by the Client.

The Service Provider shall not be held liable in the event of force majeure.

ARTICLE 8 – Personal Data

The personal data collected is necessary for the performance of the Services and is used solely for this purpose.

• Right of access, rectification, and deletion
• Right to object and right to data portability
• Right to withdraw consent

ARTICLE 9 – Intellectual Property

All content on the website www.skillsmetry.com is protected by intellectual property laws. Any reproduction is strictly prohibited.

ARTICLE 10 – Governing Law

These GTC are governed by French law. In the event of translation, only the French version shall prevail.

ARTICLE 11 – Disputes

In the event of a dispute, the Client may resort to mediation via: https://www.economie.gouv.fr/mediation-conso

Failing amicable settlement, French courts shall have exclusive jurisdiction.

APPENDIX I – Withdrawal Form

This form must be completed only if the Client wishes to withdraw, subject to the exclusions provided for in these GTC.
